Terms of Service

This Terms of Service agreement (the “Agreement”) is a legally binding contract between you (“User” or “Participant”) and JAVIEFX Mentoring Limited, a company incorporated under the laws of Jamaica, and where applicable, AshVan Global LLC, a U.S.-registered entity that facilitates payment processing and operates the JavieFX Elite VIX Insights Service (“Insights Service”).
Important: All services and content provided by JavieFX Mentoring Limited and AshVan Global LLC are strictly for educational and informational purposes. Nothing is to be construed as financial advice or a solicitation to buy or sell financial instruments.
By enrolling in, accessing, or utilizing any service, product, course, or insight provided by JAVIEFX Mentoring Limited or AshVan Global LLC (collectively, the “Company”), you confirm that you have read, understood, and agree to be bound by the terms outlined herein. If you do not agree, you must discontinue all use of the Company’s services immediately.
1. Operator Information
All services under the JAVIEFX brand are operated by JAVIEFX Mentoring Limited, a registered company in Jamaica.
⚠️ Please note: As of April 2, 2025, all individuals who purchase or subscribe to the JavieFX Elite VIX Signals Service acknowledge that they are doing business with AshVan Global LLC. All payments, interactions, and support related to the Signals Service are administered through AshVan Global LLC.
2. Educational Nature of Services
2.1 Informational Purpose Only
All products, courses, and insights are provided for educational and informational purposes only. Nothing offered by the Company constitutes financial advice, investment recommendations, or trading instructions.
2.2 No Financial Licensing
The Company and its representatives are not licensed financial advisors or brokers. No part of the service is regulated or certified under any financial authority.
3. User Responsibilities
You are solely responsible for:
Your own trading decisions
Performing independent research and due diligence
Managing your capital, risk tolerance, and account settings
You must never trade with funds you cannot afford to lose.
4. Market Insights Disclaimer
4.1 Nature of Insights
The Insights Service provides market scenarios and educational commentary intended for demonstration and learning purposes only. The Company does not guarantee the accuracy, consistency, or outcome of any market observation.
4.2 Independent Risk Management
By subscribing to or using any insights:
You accept full responsibility for your trading decisions and risk exposure.
You must apply your own risk management strategies.
You understand that trading synthetic indices and derivatives involves significant risk, including the potential loss of all capital.
4.3 No Liability for Losses
Neither JAVIEFX Mentoring Limited nor AshVan Global LLC will be liable for:
Financial losses incurred based on any insight provided
Missed trading opportunities or delays in content delivery
Misinterpretation or misuse of any educational material
4.4 No Guarantees
The Company does not guarantee that any educational material, market insights, or scenarios will result in financial gain. Outcomes are based on individual application, market volatility, and user discretion.
5. Refund Policy
5.1 No Refunds
All sales are final. No refunds will be issued under any circumstances, including but not limited to:
Dissatisfaction with the course or insights
Missed sessions or content
Technical or scheduling conflicts
It is your responsibility to evaluate the suitability of any service before purchase.
6. Course Information
6.1 Live Trading Sessions
The JAVIEFX 1 Month Live Trading Session is conducted live over two to four weeks. Recordings are not guaranteed. Participants are expected to attend all scheduled sessions.
7. Broker Relationships
7.1 Third-Party Brokers
The Company may refer users to brokers (e.g., Deriv) via affiliate links. These are independent third-party entities, and the Company makes no warranties about their services.
7.2 No Endorsement
Engagement with third-party brokers is done at your own risk. The Company is not liable for their performance or reliability.
8. Insights Group Terms & AshVan Global LLC
8.1 Entity Relationship
As of May 24, 2025, any user enrolling in or making payments for the JavieFX Elite VIX Insights Service is deemed to be entering into a business relationship with AshVan Global LLC.
8.2 Risk Disclaimer
By subscribing to the Insights Service:
You acknowledge that trading involves significant risk
You are 100% responsible for your decisions and risk management
You agree that AshVan Global LLC and JAVIEFX Mentoring Limited are not liable for any losses, missed opportunities, or damages related to your use of insights
8.3 Frequency Disclaimer
The JavieFX Elite VIX Insights Service typically provides market insights between 1 to 7 times per week. However, frequency is not guaranteed and depends on market conditions and provider discretion. There may be periods without insights when market conditions are unfavorable.
9. Assumption of Risk
By using the Company’s services, the Participant acknowledges that trading financial instruments (including synthetic indices and derivatives) involves significant risk. The Participant accepts full responsibility for evaluating their financial situation and suitability for trading. The Company shall not be held liable for any financial loss.
9.1 Limitation of Liability
To the fullest extent permitted by law, JAVIEFX Mentoring Limited and AshVan Global LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, trading losses, or business interruption, even if advised of the possibility of such damages.
10. Account Termination
The Company reserves the right to suspend or terminate access without notice or refund for abuse, harassment, intellectual property violations, or behavior deemed harmful to the Company or other users.
11. Technology Disclaimer
The Company is not responsible for technical issues caused by third-party platforms such as Telegram, Kajabi, or your internet provider. Delivery of insights or course content may be affected by such issues.
12. Force Majeure
The Company shall not be held liable for any delay or service disruption caused by events outside of its control, including but not limited to natural disasters, cyberattacks, war, technical failures, or regulatory changes.
13. Electronic Communications Consent
By using the Company’s services, you consent to receive communications electronically via email, Telegram, or other messaging platforms.
14. Earnings & Results Disclosure
Any references to income, success, or lifestyle outcomes are for illustrative purposes only. They are not guarantees of future performance. Individual results will vary.
15. Amendments
This Agreement may be updated at any time. Continued use of the Company’s services constitutes acceptance of the updated Terms.
16. Dispute Resolution
Any disputes shall first be addressed through good-faith negotiations. If unresolved, disputes will be submitted to binding arbitration under the Arbitration Act of Jamaica. Arbitration will be conducted in Kingston, Jamaica, in English. The decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction. You waive the right to trial by jury or participation in class actions.
17. Governing Law
This Agreement is governed exclusively by the laws of Jamaica. All disputes are subject to Jamaican jurisdiction.

19. Intellectual Property
All content, graphics, branding, market insights, educational materials, and proprietary methods shared by JAVIEFX Mentoring Limited are protected by copyright and other applicable laws. Unauthorized reproduction, distribution, or resale is strictly prohibited. Violators may be subject to legal action.
20. Community Conduct
Users are expected to maintain respectful and professional behavior in any community forums or private channels (e.g., Telegram). Harassment, self-promotion, spamming, or disruptive behavior will result in immediate removal without refund. The Company reserves the right to restrict access at its sole discretion.
21. Severability
If any provision of this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
